Regulation (EU) No 604/2013 of the European Parliament and of the Council establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person.
4. Summary
This Regulation establishes the criteria and mechanisms for determining which EU Member State is responsible for examining an application for international protection (asylum) submitted by a third-country national or a stateless person in one of the Member States.
The main criteria, listed in order of priority, include:
– The presence of family members legally residing in another Member State;
– The issuance of a visa or residence permit by a Member State;
– The first Member State of entry, whether legal or irregular.
The Regulation aims to ensure that only one Member State is responsible for examining each asylum application, thereby preventing multiple applications in different Member States.
5. Expiry
The Regulation remains in force but will be replaced by Regulation (EU) 2024/1351 (Asylum and Migration Management Regulation) on 30 June 2026.
